Right of Withdrawal for Consumers
Consumers generally have a statutory right of withdrawal.
Special Provisions for Digital Content
For contracts involving digital content that is not supplied on a physical medium (for example software, licenses or digital downloads), the right of withdrawal may expire prematurely.
Expiration of the Right of Withdrawal
The right of withdrawal expires once:
• the consumer has expressly agreed that the trader may begin performing the contract before the withdrawal period has expired
• the consumer has confirmed that by giving this consent they lose their right of withdrawal once the performance of the contract begins
Beginning of Contract Performance
Performance of the contract begins when access to the digital content is provided.
This may occur, for example, through:
• provision of a license code
• activation access
• digital download
• device-bound software configuration
Once access to the digital content has been provided, the service is considered to have begun.
Consent in the Ordering Process
The required consent and confirmation regarding the possible expiration of the right of withdrawal are obtained during the ordering process before the order is completed.
